Landlord Legal Requirements

The safety of tenants is a landlord’s responsibility. The Gas Safety (Installation and Use) Regulations 1998 cover the duties of landlords to ensure that all gas appliances, fittings and flues provided for tenants are fit more purpose and not hazardous. Additionally, this also refers to any communal spaces that tenants have access to.

Landlords also hold the responsibility for ensuring the maintenance and repair of flues, appliances and pipework within their properties. It is imperative to employ a Gas Safe registered engineer. Although there is no specific timeframe dictated as to when these duties must take place, common sense and a proactive attitude would equate to annyal checks allowing any necessary repairs to be carried out quickly.

An annual gas check is a legal requirement and the landlord’s responsibility, again this must be undertaken by a Gas Safe Registered engineer. Landlords are obliged to maintain a record of the gas safety check for 2-years and give a copy to each existing tenant within 28 days of it being carried out. All new tenants must also be given a copy prior to moving in.

Under a 2018 amendment of the regulations, landlords can have the annual gas safety check undertaken up to 2 months prior to the date the check must be carried out and still keep the original deadline date.
