Landlord Legal Requirements
The safety of tenants is the responsibility of their landlords. The Gas Safety (Installation and Use) Regulations 1998 covers the obligations of landlords to ensure all gas appliances, fittings and flues provided for tenants are fit-for-purpose and pose no danger to the tenants or property. This includes communal areas, which could be utilized by tenants.
Landlords are accountable for the upkeep and repair of flues, appliances and pipework for use by the tenants. In order to do so, they must enlist the services of a Gas Safe registered engineer. Even though there is no specific time given during which this should take place, a responsible landlord should ensure that regular, annual assessments are completed.
It is the legal responsibility of landlords to make sure that an annual gas safety check is completed within a year of the installation of gas or a flue, and then every twelve months thereafter. This safety check must be completed by a Gas Safe registered engineer. Landlords must maintain a record of the history of safety checks for a minimum of two years and provide a copy to each tenant within four weeks of the check being carried out. Any new tenants must receive this prior to moving in.
A recent change to the Regulations in 2018 means that landlords are now able to have the annual gas safety check carried out up to 2 months before the due date and it is still possible to keep the original deadline date.
